Taxation of Land - Lesson 4 of 6

Explores the rules that stop related parties from resetting a property's tax character simply by passing it between themselves. This session focuses on section CB15, which extends the 10-year business-based charging provisions (CB9–CB12) to a person who was associated with a dealer, developer or builder at the time of acquisition — even if they never carried on that business themselves. Participants then work through the general associated persons tests in sections YB2 to YB14: relationships between natural persons, a person and a company, two companies, trustees and beneficiaries, partners in a partnership, and the tripartite test that aggregates indirect relationships. The session explains how association can cause a purchaser to inherit a vendor's acquisition date or tainted intention, and why exclusions like the main home exclusion don't override an associated persons charge. Designed for accountants, lawyers, property professionals and informed owners, the session uses plain language and worked examples so you can identify when association changes the answer. This lesson prepares you for next lessons GST and the practical case studies in Lesson 6.
